Federal Court Hands a Victory to the House of Representatives

Washington D.C. – Today, in a victory for the Constitution and the American people, a federal district judge ruled in House v. Burwell that the Obama administration unlawfully funded parts of Obamacare without an appropriation from Congress. Congressman Ted S. Yoho (R-FL-03) issued the following statement:

“Executive overreach has been a common occurrence with the Obama White House. The power of the purse resides with the House of Representatives. The President knows this and still chose to go around Congress and use taxpayer funds to reimburse health insurers. Today’s ruling is not only a victory for the Constitution; it will save the American taxpayer billions of dollars.”

July 30, 2014: At Speaker Boehner’s urging, the House passes H. Res. 676, authorizing litigation against the Obama administration.

November 21, 2014: The House files litigation against the administration regarding unilateral actions under Obamacare.

May 28, 2015: The court hears oral arguments in the case.

September 9, 2015: The court rules that the House has standing in the case.

October 19, 2015: The court denies the Obama administration’s request to appeal directly to the Circuit Court of Appeals.
